TWO NEW LAWS FOR PUBLIC REVIEW - The Ministry calls for active participation for the best legal solutions in geology and mining

The Ministry of energy, mining and mineral resources is in the final stage of preparing two new, modern and strategically important draft laws:

· Draft Law on Geology

· Draft Law on Mining

They replace the existing Law on mineral resources and their preparation represents a thorough, institutional and expert-based reform, prepared by experts from the Ministry itself.

The law is fully aligned with European regulations. The draft laws are in line with the best European practices and transpose REGULATION (EU) 2024/1252 of 11.04.2024.

As of 28.07.2025, both draft laws are available on ENER (Electronic National Register of Regulations), where they will be available until 28.08.2025, for public review and exchange of opinions, suggestions and comments from all stakeholders.

We call on all stakeholders – experts, municipalities, companies, civil society organizations and individuals – to actively engage. This is an opportunity for all stakeholders to influence the creation of rules that will regulate the geology and mining sector on a long-term basis. The goal is to jointly build the best possible legal solution that will ensure:

1. Better environmental protection

· Strict environmental standards in the exploration, exploitation and processing of mineral resources

· Obligation to rehabilitate and recultivate the terrain after the completion of mining activities.

· Possibility of processing and utilizing mineral resources from old dumps.

2. Support for local communities

· The majority of fees for mineral resources and mining revenues to remain in the municipalities where exploitation is carried out.

· Obligations for companies to invest in local infrastructure and social development.

· Involvement of communities in decision-making processes.

3. Greater control and transparency

· Efficient regulation of the mining sector with these legal solutions that will ensure better protection of natural resources

· The public will have greater insight into the concession awarding process.

· Stronger supervision by state institutions.

4. Greater economic benefit for the state

· Higher fees and mining fees.

· Precisely defined rights and obligations of concessionaires.

· Encouraging domestic and sustainable investments.

· Promoting the economic potential of mining.

5. Preventing illegal exploitation

· Fighting "wild mines" and illegal mining.

· Control of the quantity and quality of mined mineral resources

· The strictest penalties for violations and abuses.
